To start, you canOn the 15th of March 2022, at 9 pm, I was dispatched, in response to a complaint, by
the Madelia City Police department to a residential building near Pioneer Bank, Madelia City.
The department had received an emergency service call indicating that a crime of breaking
and entering was in progress. Upon arrival at the scene, I discovered the suspect in the act of
breaking and entering the premises. I immediately apprehended and handcuffed him. As per
standard procedure, I searched the suspect and discovered a loaded gun concealed in his
trousers. I disarmed him and placed the gun in an evidence bag.
At this point, the victim of the intended breaking and entry had come out onto the
patio and she informed me that the suspect was her son. He was currently on parole after a
previous conviction for violating the Minnesota Crimes; Fireworks; Firearms Statute (Office
of the Revisor of Statutes, n.d.). If the victim’s assertions were true, then this suspect was a
parolee. Possessing a firearm thereby constituted probable cause that a felony was being
committed. Therefore, I proceeded to formally arrest the suspect and take him into custody. I
also informed the suspect that I was arresting him for the gross misdemeanor crime of
breaking and entering, and also for possessing a firearm, a dangerous weapon, while being a
parolee.
I also informed the suspect that his actions violated the Minnesota’s Restoration of
Civil Rights; Possession of Firearms, and Ammunition Law (Office of the Revisor of
Statutes, n.d.)). I administered the Miranda Warning to the suspect, informing him of his
right to remain silent or any information he divulged would be used against him in a court
proceeding, and of his right to have his attorney present during any questioning. Once at the
police station, the suspect was formally charged with breaking and entering. The booking
officer informed the suspect that he would shortly be arraigned in court where he would be

expected to enter a plea of guilty to all of the charges or deny the allegations leveled against
him.
A prosecutor would present the legal case against the suspect, and he, as a
defendant, would have the right to a fair trial; this is the due process of prosecuting a
suspect. As part of this due process, the defendant would be permitted to speak on his own
behalf or to call upon any witnesses to speak for him. Upon the conclusion of the subsequent
trial, if the jury find evidence, beyond any reasonable doubt, that the defendant had
committed the alleged crimes, he would be convicted and sentenced as per the applicable
law.
