Affirmative action is the reservation policy that aims to enable equity and access to higher
education. These policies are developed on the political system and target underrepresented
groups which are based on ethnicity, race, gender, and, others. The Supreme Court can recede
affirmative action after consideration of rationales that cite the reasons.
According to the HuffPost students for fair admissions that is the white and Asian students v.
Harvard and also v. the University of North Carolina advocates the end of affirmative action.
They claim the use of race in admissions that helps in enrolling black, native American, and
Hispanic students is unconstitutionally discriminating against them by violating VI of the Civil
Rights Acts and the 14 th Amendment Equal protection clause that grants equal treatment to all
persons under the law (The Supreme Court’s Conservatives Are Going To End Affirmative Action
In Higher Education, 2022 ) . The lawyer for fair admission asked the court to overrule its prior
precedents that authorized use of race to achieve diversity. The counterargument is an example
of states that banned race admissions and found race-neutral policies led to reduced numbers of
Hispanic and black enrollment in highly selective colleges and universities.
According to town hall students of fair argue that both universities violate the U.S constitution in
their discriminating admissions policy. This discrimination is against Asian America in favor of
whites, black and Hispanic. The consensus is that students of fair admissions will win the case
and abolish racial discrimination in university admission. This is a victory for those who see
affirmative action as a mistake of the civil rights movement (Parker, n.d.) .
The huff post articulates well the end of affirmative action consequences for the race and also
instigates a lose-lose situation for those against affirmative action and those that support it. The
town hall is clearly against affirmative action and from the above case the win opens a window
for challenging other affirmative action policies.
